Terms and Conditions
Terms & Conditions
1. Scope
These Terms and Conditions apply to all orders placed via our online shop.
The shop is operated by:
Behind Media Group GbR
Haberstraße 6
69126 Heidelberg
Germany
Email: info@behind.group
2. Contracting Party
The purchase contract is concluded with Behind Media Group GbR.
3. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
You submit a binding offer when you complete the ordering process and confirm your order via the button to place a paid order.
After receiving your order, you will receive an automatic order confirmation by email. This confirmation does not yet constitute acceptance of your order unless expressly stated otherwise. The purchase contract is concluded once we accept your order, begin processing it, or confirm dispatch.
4. Products and Print-on-Demand
Our products are partially or fully produced using the print-on-demand process. This means products are manufactured, printed, or finished after the order is received.
The designs, motifs, colours, sizes, and variants offered are determined by us. Customer-side personalisation only takes place where this is explicitly stated for the respective product.
5. Prices and Shipping Costs
All prices include the applicable statutory VAT.
Additional shipping costs may apply. The exact shipping costs are displayed at checkout before you complete your order.
For deliveries outside the European Union, additional import duties, customs fees, or taxes may apply in individual cases where these are not already included in the shipping price. These charges are levied by the relevant authorities and are the responsibility of the customer.
6. Payment
The payment methods shown at checkout are available in our shop. These may include in particular Shopify Payments, credit card, PayPal, Apple Pay, and Google Pay.
Payment is due upon completion of the order, unless otherwise stated at checkout.
7. Delivery
Delivery is made to the delivery address provided during the ordering process.
As our products are produced using the print-on-demand process, the delivery time consists of production time and shipping time. Delivery times stated on the website are estimates and may vary depending on the product, destination country, shipping provider, public holidays, customs processing, or seasonal demand.
If a product is unavailable or delivery is significantly delayed, we will notify you by email.
8. Retention of Title
The goods remain our property until full payment has been received.
9. Right of Withdrawal
Consumers have a statutory right of withdrawal. Full details can be found on our Right of Withdrawal & Returns page.
The cost of returning goods in the event of withdrawal is borne by the customer, provided the goods delivered correspond to the goods ordered and are not defective.
10. Exclusion of Right of Withdrawal for Personalised Products
The right of withdrawal does not apply to goods that are not prefabricated and whose production is determined by an individual selection or specification by the consumer, or which are clearly tailored to the personal needs of the consumer.
This applies only to products with genuine customer-side personalisation, such as individual names, texts, special motifs, or custom-made items. Standard size, colour, or design selection from our shop does not constitute individual personalisation.
11. Complaints, Defects, and Incorrect Deliveries
Statutory rights regarding defects apply.
If a product is damaged, incorrectly printed, wrongly delivered, or defective, please contact us at info@behind.group and, where possible, provide the following information:
- Order number, if available
- Description of the issue
- Photos or videos of the defect
- Photo of the shipping label, if relevant
For justified complaints, we will provide an appropriate remedy, such as a replacement delivery, rectification, or refund.
Your statutory rights remain unaffected.
12. Size Selection and Fit
Please check the relevant size guide before placing your order. An incorrectly chosen size does not constitute a product defect if the ordered size was correctly delivered.
In this case, you may exercise your statutory right of withdrawal, provided the conditions are met. We do not currently offer free size exchanges.
13. Vouchers and Discount Codes
Vouchers and discount codes may only be redeemed within the stated period and subject to the applicable conditions. Retrospective application to already completed orders is not possible.
14. Liability
We are fully liable for damages arising from injury to life, body, or health, as well as for damages caused by intentional or grossly negligent breach of duty.
We are also fully liable where liability is mandatory under applicable law, in particular under product liability law, or where we have fraudulently concealed a defect or assumed a guarantee.
In the event of a slightly negligent breach of material contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Material contractual obligations are those whose fulfilment is essential to the proper performance of the contract and on whose compliance the customer may regularly rely.
Any further liability is excluded to the extent permitted by law.
15. Intellectual Property and Designs
All content, designs, texts, images, graphics, logos, product motifs, and other content in our shop are protected by copyright or trademark law unless otherwise stated.
Use, reproduction, or distribution without our prior consent is not permitted.
16. Language of Contract
The language of contract is English.
17. Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
18. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
